Terms and Conditions DEFINITIONS

Buyer: The person who buys or agrees to buy the goods from the seller.

Conditions: The terms and conditions of the sale as set out in this document and any special terms and conditions agreed in writing by the seller.

Goods: The articles which the buyer agrees to buy from the seller.

Price: The price for the goods, excluding VAT and any carriage,packaging and any insurance costs unless otherwise stated


  1. These conditions shall form the basis of the contract between the seller and the buyer in relation to the sale of goods, to the exclusion of all other terms and conditions including the buyers standard conditions of purchase or any other conditions which the buyer may apply under any purchase order or confirmation of order or any other documents.
  2. Acceptance of order acknoledgement of the goods shall be deemed to be evidence of the buyers acceptance of these conditions. It is the responsibility of the purchaser to ensure that all legal for trade applications, have been complied with if there is any doubt as to legal matters please call your local trading standards dept
  3. All orders for goods shall be deemed to be an offer by the buyer to purchase goods from the seller subject to these conditions of sale
  4. If the Purchaser cancels any Purchase Order or part thereof he shall be liable to the seller for the payment of cancellation charges as follows: Over 90 days 15%, 61-90 days 25% and 0-60 days 40%, these charges being a percentage of the quoted price and  may not be varied except by the written agreement of the seller.
  5. These conditions represent the whole of the agreement between the seller and the buyer PRICES. Price is the current price less any discount that has been agreed by the seller. The price is exclusive of VAT which shall be due at the rate in force on the date of the sellers invoice unless stated on the web page please print the page off for your records. The prices offered on this site will be confirmed at order confirmation, if an error has occurred in the displayed price and the actual price Scale Direct (Scotland) Ltd reserves the right to supply such goods at the lower value. We also reserve the right to cancel any order where the price offered is incorrect or product is nopt available.
  6. WARRANTIES The seller warrants that the goods will at the time of delivery correspond to the description given by the seller in the confirmation of order and all hardware carries a 12 month Warranty. It's the buyers responsibility to get a returns notice, prior to returning goods and to discuss the fault prior to this. Equipment returned MUST include any power supplies and shipping costs are excluded, Products found to be faulty as a result of the use of incorrect power chargers will not be covered under warrenty, re-verification fees are excluded and charged following repairs.
  7. SOFTWARE TOOLS - Increasingly manufacturers are providing software with the goods to provide the entry of database information which is provided for management use only. We reccomend the software is used as intended and that all data is entered via the user interface of the software provided.  It is the responsibility of the USER to ensure the End User Licence Agreement  (EULA) of the said software is strictly adhered to. Some software has features that enable exporting or importing data from third parts microsoft products,  we reccomend that a 3 backups are made prior to making said export / import and staff have the necessary skill sets to carry out this complex proceedure. Scale Direct Scotland accepts no responsibility for any errors in using the said software for import and export processes. The software is provided for a single computer PC  location and may not be put on servers or addition computers without autherisation.
  8. SOFTWARE TOOLS (cont'd) -  Customers must validate any imported / exported data is correct for the machine PRIOR TO IMPORTING to ensure it is in the correct information and format, the fields of information is correct, and the data is in the correct font, size and alignment, we reserve the right to charge for repairs  to rectify these issues. Any advise given is based on our understanding of the operation at the time, however it is the responsibility of the user to validate operation on their machine prior to production to ensure no errors. Software users must carry out a risk assesment of any software products and have a method statement in place in case of probelems arising as technology changes to hardware and operating systems change regularly, and must pay any costs associated with correction of their use, including but not retricted to Windows operating systems, firewalls, security etc and is the users reponsability.
  9. DELIVERY OF THE GOODS Delivery is normally 7-10 working day or as advised from our suppliers due to workload or availability of product. All orders where fittings such as scoops or stamped approved for trade scales (stamping) are being provided the dispatched may be longer. We normally deliver to the UK Mainland but have special arrangements for highland & Islands that keep costs low. An additional surcharge may be added dependant on our carriers for Island deliveries but we will advise at order acceptance, If you have not received your order WITHIN 3 DAYS OF invoice email notification please contact us
  10. ACCEPTANCE OF THE GOODS The buyer shall be deemed to have accepted the goods following delivery to the buyer. The buyer shall carry out a thorough inspection of the goods upon delivery and shall give written notification to the seller within 24 hours of delivery of the goods of any deficits which a reasonable examination would be revealed. Where the buyer has accepted, or has been deemed to have accepted, the goods the buyer shall not be entitled to reject goods which are not in accordance with a contract. AFTER 7 days all goods are deemed to have arrived safely and to be in satisfactory condition and suitable for purpose if there are any problems you must email us within this time to make a claim.
  11. TITLE AND RISK Risk shall pass on full payment of the goods to the buyers business address. Not withstanding the earlier passing of risk, title in the goods shall remain with the seller and shall not pass to the buyer until the amount due under the invoice for them(including interest and costs) has been paid in full. Until title passes the buyer shall hold the goods as bailee for the seller and shall store or mark them so that they can at all times be identified as the property of the seller. The seller may at any time before title passes and without any liability to the buyer  Repossess and dismantle and use or sell all or any of the goods and by doing so terminate the buyers right to use, sell or otherwise deal in them and for the purpose (or determining what if any goods are held by the buyer and inspecting them) enter any premises of or occupied by the buyer. The seller may maintain an action for the price of any goods not withstanding that title in them has not passed to the buyer.
  12. Returns Policy (Consumer Contract Regulations) If you are not happy with your purchase, you must return the item within 14 days of delivery (excludes approved or stamped / modified equipment or jewelry scales where it has been stamped for your geographical location, along with the original invoice. We will credit your account, or exchange the item for another selection.
  13. In case of returns shipping is excluded and we will credit your account less a 20% handing fee which is are not refundable. The goods must be complete, unopened undamaged and unsoiled, unused and with the original packaging and labels manuals calibration cerfificates etc intact.
  14. Scales that have been built to order (including Calibration Certificates, Configurations & Fittings) or Trade Approved scales are excluded from returns, if you wish to view these prior to purchase please contact our sales team who will be happy to assist you or arrange a demonstration where possible, particularly Labelling Scale which require programming before use.
  15. Further to United Kingdom Consumer Contract Regulations we regret we cannot accept cancellations of contracts for the purchase of bench scales,floor scales,moisture analysers, labelling scales,and medical scales where we have calibrated the unit for your geographical region. Excludes consumable items such as labels,power supplies,filter paper etc as these may have to purchased from our suppliers and cannot be returned unless faulty, if in doubt as to the correct part suitable for your requirements call us direct.
  16. Where products are shown with £0, these are usually associated with being of a specialist nature, in order to supply these products we need more information on your application, and our sales staff will require to prepare & submit a quotation specific to your needs. Hire products or services are subject to availability and suitability of application. We only offer HIRE products to registered companies, and based within a 45mile geographical area of G69 7TU. We do not supply to third parties due to improper use, and damage.
  17. Payments

    We use worldpay secure payment service and our site complies with the industries Payment Card Secirity Data Standards (PCI DSS) Standards and no card details are retained on our website and your information will be used by them to validate payments we have no control on their GDPR data
  18. Cookies

    We use cookies on the website to make it work, and Google Analytics to analyse the use of our website and they are retained for 14 months . Google Analytics gathers information about website use by means of cookies. The information gathered relating to our website is used to create reports about the use of our website.   19. GDRP - Privacy Policy

    Scale Direct Scotland Ltd does not sell, rent or provide information to any marketing companies. We only use the information you provide us to contact you in direct response to your enquiry, or provide a detailed quotation or service. We also share your contact details only with carriers in order for your goods to be delivered, but do not have any control over the information retained by them

  20. Approved scales

    It is the responsibility of the purchaser to ensure the purpose to which they are using the scales meet National and local weights and measures regulations, Scale Direct Scotland  Ltd accepts no liability whatsoever , unless a formal offer that has been submitted for the application to which it applies, any special requirements i.e. approved counting scales must be quoted direct in order to check the pattern approval is valid under UK 2016 weights and measures act. All approved scales are built to order as such are not covered under the distance selling regulations.
