Terms and Conditions DEFINITIONS

Price: The price for the goods, excluding VAT and any carriage, which will be calculated and charged for when you select the shopping cart unless otherwise stated

Terms & CONDITIONS

  1. These conditions shall form the basis of the contract between the seller and the buyer in relation to the sale of goods, to the exclusion of all other terms and conditions including the buyers standard conditions of purchase or any other conditions which the buyer may apply under any purchase order or confirmation of order or any other documents.
  2. Acceptance of order acknoledgement of the goods shall be deemed to be evidence of the buyers acceptance of these conditions and the tick box must be confirmed in order to complete payment. It is the responsibility of the purchaser to ensure that all legal for trade applications, have been complied with.
  3. All orders for goods shall be deemed to be an offer by the buyer to purchase goods from the seller subject to these conditions of sale
  4. If the Purchaser cancels any Purchase Order or part thereof he shall be liable to the seller for the payment of cancellation charges as follows: Over 90 days 15%, 61-90 days 25% and 0-60 days 40%, these charges being a percentage of the quoted price and  may not be varied except by the written agreement of the seller.
  5. These conditions represent the whole of the agreement between the seller and the buyer PRICES. Price is the current price less any discount that has been agreed by the seller. The price is exclusive of VAT which shall be due at the rate in force on the date of the sellers invoice unless stated on the web page please print the page off for your records. The prices offered on this site will be confirmed at order confirmation, if an error has occurred in the displayed price and the actual price Scale Direct (Scotland) Ltd reserves the right to supply such goods at the lower value. We also reserve the right to cancel any order where the price offered is incorrect or product is nopt available.
  6. WARRANTIES The seller warrants that the goods will at the time of delivery correspond to the description given by the seller in the confirmation of order and all hardware carries a 12 month Warranty. It's the buyers responsibility to get a returns notice, prior to returning goods and to discuss the fault prior to this. Equipment returned MUST include any power supplies and shipping costs are excluded, Products found to be faulty as a result of the use of incorrect power chargers  are consumable items, not be covered under warrenty, original MANUFACTURERS ADAPTORS MUST BE USED re-verification fees are excluded and charged following repairs.we are not liable for any consequential losses, costs or damages however arising.
  7. Extended Manufacturers provided by Warranty promotions applies to Products  From SDS Ltd & Registered with Calibration Certificates, and subject to MANUFACTURERS return to base  terms and conditions (excludes items subject to wear and tear, consumables such as power adapters,batteries,keyboards etc load misuse and load cell damage.
    Subject to the conditions set out below the Seller warrants that the Goods will correspond with their specification at the time of delivery and will be
    free from defects in material and workmanship for a period of 12 months (unless extended or amended by the Seller in writing) from delivery.
    The above warranty is given by the Seller but the Seller shall be under no liability in respect of:
    Any defect arising from any drawing, design or specification supplied by the Buyer;
    Any defect arising from fair wear and tear, wilful damage, negligence, abnormal working conditions, failure to follow the Seller's instructions
    (whether oral or in writing), misuse or alteration on repair of the Goods without the Seller's approval, the above warranty (or any other warranty, condition or guarantee) if the total price for the Goods has not been paid by the due date for
    payment;
    For the avoidance of doubt the above warranty does not extend to parts, materials or equipment not manufactured by the Seller, in respect of
    which the Buyer shall only be entitled to the benefit of any such warranty or guarantee as is given by the ma nufacturer to the Seller.
    Subject as expressly provided in these Conditions, and except where the Goods are sold to a person dealing as a consumer (within the meaning of
    the Unfair Contract Terms Act 1977), or any statutory meaning all warranties, conditions or other terms implied by statute or common law are excluded
    to the fullest extent permitted by law.
    Where the Goods are sold under a consumer transaction (as defined by the Consumer Transactions (Restrictions on Statements) Order 2976) or
    any statutory amendment the statutory rights of the Buyer are not affected by these Conditions.
  8. SOFTWARE TOOLS - Increasingly manufacturers are providing software with the goods to provide the entry of database information which is provided for management use only. We reccomend the software is used as intended and that all data is entered via the user interface of the software provided.  It is the responsibility of the USER to ensure the End User Licence Agreement  (EULA) of the said software is strictly adhered to. Some software has features that enable exporting or importing data from third parts microsoft products,  we reccomend that a backup is  made prior to making said export / import and staff have the necessary skill sets to carry out this complex proceedure. Scale Direct Scotland accepts no responsibility for any errors in using the said software for import and export processes. The software is provided for a single computer PC  with serial number  and may not be put on servers or addition computers without purchase of additional licences or permissions.
  9. SOFTWARE TOOLS (cont'd) -  Customers must validate any imported / exported data is correct for the machine PRIOR TO IMPORTING to ensure it is in the correct information and format, the fields of information is correct, and the data is in the correct font, size and alignment, we reserve the right to charge for repairs  to rectify these issues. Any advise given is based on our understanding of the operation at the time, however it is the responsibility of the user to validate operation on their machine prior to production to ensure no errors. Software users must carry out a risk assesment of any software products and have a method statement in place in case of probelems arising as technology changes to hardware and operating systems change regularly, and must pay any costs associated with correction of their use, including but not retricted to Windows operating systems, firewalls, security etc and is the users reponsability. Users System Administrators must comply with End User Licences Aggreements (EULA) for any of our products or any of our suppliers or third party manufacturers copies of which are available on request. Any Software products must be re-registed and annual fees due, paid prior to continued use
  10. DELIVERY OF THE GOODS Delivery timescales are shown are estimated in working days (Monday - ,Friday). and where items are out of stock due Brexit / Manufacturers factories that have issues in supply of components or our wholesalers, back orders will be confirmed at time of order as advised from our suppliers due to workload or availability of product and carrier timescales. If time critical deliveries are required please select the "Quotation Request,please select items from website and add to basket" option which can be used to place order @ no charge to your card and then having to raise a credit.  All orders where fittings such as scoops or stamped approved for trade scales (stamping) are being provided the dispatched may be longer. We normally deliver to the UK Mainland but have special arrangements for highland & Islands that keep costs low. An additional surcharge may be added dependant on our carriers for Island deliveries but we will advise at order acceptance, If you have not received your order WITHIN 3 DAYS OF invoice email notification please contact us. Delivery  are given in good faith at time of order, however delays due to carrier delays which are outwith our direct control shall be not be reasons for return.
  11. ACCEPTANCE OF THE GOODS The buyer shall be deemed to have accepted the goods following delivery to the buyer. The buyer shall carry out a thorough inspection of the goods upon delivery and shall give written notification to the seller within 24 hours of delivery of the goods of any deficits which a reasonable examination would be revealed. Where the buyer has accepted, or has been deemed to have accepted, the goods the buyer shall not be entitled to reject goods which are not in accordance with a contract. Please inspect your order upon reception and contact us immediately if the item is defective, damaged or if you receive the wrong item, so that we can evaluate the issue and make it right AFTER 7 days all goods are deemed to have arrived safely and to be in satisfactory condition and suitable for purpose if there are any problems you must email us within this time to make a claim.
  12. TITLE AND RISK Risk shall pass on full payment of the goods to the buyers business address. Not withstanding the earlier passing of risk, title in the goods shall remain with the seller and shall not pass to the buyer until the amount due under the invoice for them(including interest and costs) has been paid in full. Until title passes the buyer shall hold the goods as bailee for the seller and shall store or mark them so that they can at all times be identified as the property of the seller. The seller may at any time before title passes and without any liability to the buyer  Repossess and dismantle and use or sell all or any of the goods and by doing so terminate the buyers right to use, sell or otherwise deal in them and for the purpose (or determining what if any goods are held by the buyer and inspecting them) enter any premises of or occupied by the buyer.
  13. Returns Policy (Consumer Contract Regulations) you must return the item within 14 days of delivery (excludes approved or stamped / Custom Products including Accessories, scoops Labels or modified equipment or jewelry scales where it has been stamped for your geographical location), along with the original invoice. We will credit your account, or exchange the item for another selection.
  14. Paypal Payments by Card - Cancelation of order due to out of stock models   "which we were not aware of at time of order" need to be raised  with  Paypal as they can  crediting your account / Card  - We don't keep any card details on our website for security purposes.
